In what appears to be an unexpected wave of common sense, a Federal Appeals court stated, "Fear of a terrorist attack is not sufficient reason for authorities to search people at a protest", and that Sept. 11 "cannot be the day liberty perished."

"We cannot simply suspend or restrict civil liberties until the War on Terror is over, because the War on Terror is unlikely ever to be truly over," Judge Gerald Tjoflat wrote for the panel. "Sept. 11, 2001, already a day of immeasurable tragedy, cannot be the day liberty perished in this country."

The ruling came about as a challenge by a group protesting the School of America, which they claim is a mercenary/killer training camp, to the setting up of metal detectors to screen public protestoers, that the protesters claim were being used to restrict the ability for protesters to assemble and demonstrate, among other things, creating huge lines.
